Foreign-trained lawyers looking to practice in Canadian common-law jurisdictions now face additional requirements as of March 1, 2026.
Canada’s National Committee on Accreditation (NCA) has introduced two new prerequisites for foreign-trained lawyers seeking accreditation in Canadian common-law jurisdictions:
- Mandatory language screening
- A stand-alone Indigenous Law and Peoples knowledge requirement
Aside from these new conditions, foreign-trained lawyers must still fulfill all existing accreditation criteria set by the NCA to practice law in Canada.
This article will delve into how international lawyers can fulfill these new obligations.
*Common law jurisdiction in Canada encompasses all provinces and territories, excluding Quebec.
**The NCA is the official body in Canada responsible for evaluating the legal education and professional background of individuals who obtained their qualifications outside Canada or from a Canadian civil law program.
Language Screening Requirements
All NCA applicants must undergo language screening before their credentials can be assessed, unless exempted by providing a valid language test result. The language test results must be no more than two years old when submitted to the NCA.
Each applicant is allowed one attempt at the screening.
The new language screening is mandatory for both first-time applicants and those seeking a review of their credentials after additional legal studies. This means even applicants who applied before March 1 may be affected.
For English, the screening involves a proctored Versant English Placement Test, with a minimum score of 61 required.
Regarding French, the NCA currently lacks a French screening tool, so French applicants must undertake one of the approved French tests at NCA’s expense. Failure to meet the screening standard necessitates passing an accepted full language test before receiving the Certificate of Qualification.
The accepted full language tests and their minimum requirements as per the March 2026 interpretive statement are as follows:
