Foreign nationals arriving in Canada may still apply for a work permit at a port of entry (POE), but the process has become more restricted in recent years.
In an effort to tighten POE access, the federal government has implemented various measures, such as discontinuing ‘flagpoling’ for most temporary residents in Canada and ceasing POE processing for certain work permits like the Post-Graduation Work Permit (PGWP).
Here is a breakdown of which foreign nationals are eligible for a work permit at land, sea, or air borders and the types of work permits accessible through this avenue.
Obtaining a Work Permit at the Border
There are two primary processes at a port of entry:
- Applying at the POE (same-day processing): Eligible travelers can request a work permit upon arrival and submit their application directly to a border officer.
- Being issued a work permit at a POE after online approval: Foreign nationals not eligible for same-day processing apply online, receive a port-of-entry letter of introduction, and have the permit printed upon entry into Canada.
Both scenarios allow foreign nationals to obtain various types of work permits, but understanding the eligibility criteria can streamline the process and prevent border rejections.
The final decision to issue the permit and grant entry rests with the border officer.
Eligibility for Applying at a POE
As per Immigration, Refugees and Citizenship Canada (IRCC), travelers must meet the following basic requirements to apply at a POE:
- Be from a visa-exempt country or a visa-exempt traveler (e.g., lawful permanent resident of the US);
- Qualify for an electronic Travel Authorization (eTA) or be able to travel without a visitor visa (Temporary Resident Visa);
- Satisfy additional criteria based on the type of work permit sought.
Ineligibility for POE Applications
IRCC outlines scenarios where foreign nationals cannot apply for a work permit at a POE, including if they:
- Require a visitor visa to enter Canada;
- Belong to visa-required countries eligible for an eTA under specific conditions (e.g., citizens of Mexico, Brazil, and the Philippines);
- Are not US citizens or permanent residents applying under the International Experience Canada program;
- Seek entry under the Seasonal Agricultural Worker Program;
- Apply for a Post-Graduation Work Permit (PGWP); or
- Travel to the US or Saint Pierre and Miquelon from Canada for immigration services and return (flagpoling).
