The opportunity for Americans to pursue dual citizenship with Canada has significantly expanded following a recent amendment to the Citizenship Act in December of 2025.
Under the revised law, many Americans may already be Canadian citizens by descent, needing only to submit an application to confirm this status.
For eligible Americans, this pathway offers one of the quickest routes to access the full rights of Canadian citizenship, bypassing lengthy processes such as language tests and educational evaluations.
Understanding Citizenship by Descent
Americans have two primary avenues to achieve dual citizenship with Canada: through immigration, permanent residency, and naturalization, or by inheritance.
These options vary significantly in terms of the time required:
- Citizenship by Descent
- Requirement: One Canadian ancestor and supporting documents for each generation
- Residence: No relocation needed
- Physical Presence: None
- Language Test: Not required
- Citizenship Exam: Not required
- Oath Ceremony: Not required
- Processing Time: 19 months
- Naturalization
- Requirement: Canadian permanent residence
- Residence: Must move to Canada
- Physical Presence: 1,095 days (~three years) within the previous five years
- Language Test: Mandatory
- Citizenship Exam: Mandatory
- Oath Ceremony: Mandatory
- Processing Time: 6-12 months, after meeting residency requirements
It’s important to note that obtaining Canadian permanent residence can be a lengthy process, whether through economic pathways or family sponsorship. Only after acquiring permanent residence and fulfilling the physical presence criteria can an individual apply for Canadian citizenship through naturalization.
In contrast, citizenship by descent, facilitated by a proof of citizenship application, can be initiated promptly and does not necessitate any past or future residency in Canada.
